The Baden-Württemberg DPA (Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg) is the state Data Protection Authority for the German state of Baden-Württemberg. It is in charge of enforcing GDPR in the private sector within the German state of Baden-Württemberg and all governmental institutions of Baden-Württemberg.

The LfDI operates under the Administrative Procedural Act for Baden-Württemberg (Landesverwaltungsverfahrensgesetz - LVwVfG) unless there are rules in the Data Protection Act of Baden-Württemberg (Landesdatenschutzgesetz - LDSG), in the Data Protection Act for Judicial and Penalty Authorities of Baden-Württemberg (Landesdatenschutzgesetz für Justiz- und Bußgeldbehörden - LDSG-JB), in the German Data Protection Act (Bundesdatenschutzgesetz - BDSG) or another law that is lex specialis according to § 2(3) LDSG and § 2(5) LDSG-JB.

Complaints Procedure under Art 77 GDPR[edit | edit source]

According to § 25(3) LDSG the LfDI is responsible for complaints against governmental institutions of Baden-Württemberg and according to § 25(1)(2) LDSG and § 40(1) BDSG for complaints in the private sector within Baden-Württemberg.
