The Hamburg DPA (Hamburgische Beauftragte für Datenschutz und Informationsfreiheit) is the state Data Protection Authority for the German state of Hamburg. It is in charge of enforcing GDPR in the private sector, within the German state of Hamburg.
Structure
The Hamburg DPA is divided into different departments. It offers an organigram here.
Applicable Material Law
There is a Data Protection Act of Hamburg (Hamburgisches Datenschutzgesetz - HmbDSG). Corresponding § 1 HmbDSG it makes complementary arrangements to the GDPR and regulates specific situations of data processing for which the GDPR is not applicable. So the GDPR is the applicable law if there is no more specific rule in the HmbDSG or the German Federal Data Protection Act (Bundesdatenschutzgesetz - BDSG).
The first section of the HmbDSG has general provisions. In the second section the basic principles for data processing are mentioned. The third section contains provisions about specific situations of data processing. The provisions of the fourth section regulate specific situations of data processing for which the GDPR is not applicable. The fifth section contains the provisions about the rights of data subjects. The sixth section is about the Hamburg Commissioner for Data Protection and Freedom of Information. Penal provisions and a provision about administrative offence are in the last section.
