The complainant who is a private indiviual seeks the intervention of the defendant, the Hessian State Commissioner for Data Protection and Freedom of Information, regarding negative entries with the party summoned to 1 which is the Schufa Holding GmbH.
The origin lies in the contractual relationship between the complainant and a company (A) where the complainant had a credit card account. In 2017 there were payment difficulties which ended up that A commissioned the summoned party to 2 with collection of the demand. In any case the complainant paid an installment fee and further installments. But the summoned party to 2 let the summoned party to 1 register the demand. Within the framework of a later procedure against the company A before the LG Lüneburg it was disputed wether installments were accepted by the summoned party to 2. That was not clarified in the procedure. The parties agreed on a settlement in which the company (A) commits itself to revoke the negative entries towards the summoned party to 1. So the summoned party to 2 revoked them towards the summoned party to 1, but the negative entries weren't deleted. Other requests remained without success.
