V. m. Art. 21 Para. 1 DS-GVO. According to this, there is a right to erasure if the data subject objects to the processing pursuant to Art. 21 (1) and there are no overriding legitimate reasons for the processing. The plaintiff undisputedly filed an objection to the processing of personal data concerning him on February 9th, 2021 in accordance with Article 21 (1) DS-GVO. However, he had no right to object.
