Facts

In September 2019, an individual filed a complaint with the Spanish DPA (AEPD) against a boating club regarding the publication of a non-redacted judgment containing their personal data by the club on its website and Facebook page.

In January 2020, after receiving a notice informing it of the investigation, the boating club responded that it removed the link to the judgment from the relevant pages, but argued that it nonetheless considered the publication to have been lawful due to the legitimate interest (per Article 6(1)(f) GDPR) it pursued.

It rejected the argument of the boating club that the publication was lawful under Article 6(1)(f) GDPR, citing the judgment in C-13/16 (‘Rīgas satiksme') as the appropriate test to be followed to determine whether processing can be based on legitimate interest:

"first, the pursuit of a legitimate interest by the data controller or by the third party or parties to whom the data are disclosed; second, the need to process personal data for the purposes of the legitimate interests pursued; and third, that the fundamental rights and freedoms of the person concerned by the data protection do not take precedence.

After a balancing of the public's right to information against the complainant's fundamental right to the protection of their data, the AEPD held that the public benefit in publishing the judgment was insufficient to base the publication on legitimate interest per Article 6(1)(f) GDPR.

As such, the AEPD imposed a fine of €6000 on the boating club for its infringement of Article 6(1) GDPR.

RIBADEO, with NIF G27122514, for the alleged infringement of article 6.1 of the RGPD of
in accordance with article 83.5.a) of the RGPD.

"For the purposes specified in the art. 64.2 b) of Law 39/2015, of October 1, of the

72.1.b) of the LOPDGDD with a fine of 6,000 euros.”

The determination of the sanctions that should be imposed in this case requires observing
the provisions of articles 83.1 and 2 of the RGPD, precepts that, respectively, have
ne the following:

    "one. Each control authority will guarantee that the imposition of administrative fines
in accordance with this article for the infringements of this Regulation indicated in
sections 4, 9 and 6 are in each individual case effective, proportionate and dissuasive.”

    "two. Administrative fines will be imposed, depending on the circumstances of each

individual case, in addition to or as a substitute for the measures referred to in article 58,
section 2, letters a) to h) and j). When deciding to impose an administrative fine and its amount

f) the degree of cooperation with the supervisory authority in order to remedy the
infringement and mitigate the possible adverse effects of the infringement;

g) the categories of personal data affected by the infringement;


h) the way in which the supervisory authority became aware of the infringement, in particular

i) when the measures indicated in article 58, section 2, have been ordered

corrective measures":

  "one. The sanctions provided for in sections 4, 5 and 6 of article 83 of the Regulation (EU)

2016/679 will be applied taking into account the graduation criteria established in the
section 2 of the aforementioned article.

  2. In accordance with the provisions of article 83.2.k) of Regulation (EU) 2016/679, also
may be taken into account:


  a) The continuing nature of the offence.

  b) The link between the activity of the offender and the performance of data processing
personal.

  c) The profits obtained as a result of committing the offence.


  d) The possibility that the conduct of the affected party could have led to the commission of
the infringement.

  e) The existence of a merger by absorption process subsequent to the commission of the
infringement, which cannot be attributed to the absorbing entity.


  f) Affectation of the rights of minors.

  g) Have, when not mandatory, a data protection officer.

  h) Submission by the person in charge or person in charge, on a voluntary basis, to
alternative conflict resolution mechanisms, in those cases in which
there are disputes between them and any interested party.


  3. It will be possible, complementary or alternatively, the adoption, when appropriate, of the
remaining corrective measures referred to in article 83.2 of the Regulation (EU)
2016/679.”

In accordance with the precepts transcribed, in order to set the amount of the sanction of a fine
to impose in the present case for the infringement of article 83.5.a) of the RGPD, of which
holds the claimed party responsible, they are considered concurrent as aggravating

Therefore, in accordance with the applicable legislation and having assessed the graduation criteria
of the sanctions whose existence has been proven,


the Director of the Spanish Data Protection Agency RESOLVES:

FIRST: IMPOSE REAL CLUB NÁUTICO DE RIBADEO, with NIF G27122514, by
an infringement of article 6.1 of the RGPD, in accordance with article 83.5 a) of the
RGPD and 72.1.b) of the LOPDGDD, a fine of 6,000 euros.


SECOND: NOTIFY this resolution to the REAL CLUB NÁUTICO DE RIBADEO.


THIRD: Warn the sanctioned person that he must make the imposed sanction effective once

that this resolution is enforceable, in accordance with the provisions of art. 98.1.b)
of Law 39/2015, of October 1, of the Common Administrative Procedure of the
