I don't think the court ignores the wording. Art. 82 (2) GDPR states "Any controller involved in processing shall be liable for the damage caused by processing which infringes this Regulation." So the court actually read the artical right. A liability is only vor Infringements cause by processing, not for infringement of the regulation in general.
