The Agencia Española de Protección de Datos (abbreviated "AEPD") is the national Data Protection Authority for Spain. The AEPD is an independent public body in charge of enforcing the GDPR in Spain. Its head office is in Madrid. Filing an Appeal
There are two options: 1) a "recurso de reposicion" to ask the AEPD to reconsider its decision or 2) an appeal directly with the Superior Administrative Court.
Recurso: You have one month to file. The procedure is free and by law the AEPD should decide within one month upon receipt of the recurso. In practice, it will take 6 to 7 months and in most cases will not lead to a change of the decision.
Appeal with the Superiour Administrative Court: You have two months to file the appeal by announcing your intention to appeal. The Court will then request the file from the AEPD. The Court will contact you to submit your arguments. It may take 7 to 9 months after you file the appeal to reach this step.
