The Spanish Data Protection Authority (''Agencia Española de Protección de Datos'') is the national Data Protection Authority for Spain. It resides in Madrid and is in charge of enforcing GDPR in Spain.
The Agencia Española de Protección de Datos (abbreviated "AEPD") is the national Data Protection Authority for Spain. The AEPD is an independent public body in charge of enforcing the GDPR in Spain. Its head office is in Madrid. The requirement to have a data protection authority stems from Article 44 of the [https://www.boe.es/buscar/act.php?id=BOE-A-2018-16673 Spanish Data Protection Act], which is the national act developing the GDPR in Spain. The AEPD is affiliated to the Spanish Government via the Ministry of Justice.

Filing an Appeal

There are two options: 1) a "recurso de reposicion" to ask the AEPD to reconsider its decision or 2) an appeal directly with the Superior Administrative Court.

Recurso: You have one month to file. The procedure is free and by law the AEPD should decide within one month upon receipt of the recurso. In practice, it will take 6 to 7 months and in most cases will not lead to a change of the decision.
