The North Rhine-Westphalia DPA (Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen) is the state Data Protection Authority for the German state of North Rhine-Westphalia. It is in charge of enforcing the GDPR in the private sector in the German state of North Rhine-Westphalia and for the public sector under the jurisdiction of North Rhine-Westphalia (e.g. cities, districts, the police, universities and tax enforcement agencies).

Procedural Information
Applicable Procedural Law
Just like every German state, North Rhine-Westphalia enacts its own administrative procedure law and its own data protection law. In addition, some provisions of the Federal Data Protection Act apply. These include representation in the European Data Protection Committee. LDI can issue fines themselves. If fines are not appealed they can be enforced for 30 years.
Complaints Procedure under Art 77 GDPR
Complaints can be filed in writing, electronically and via fax.
Ex Officio Procedures under Art 57 GDPR
LDI can run ex officio procedures out of its own motion. Cases were so far triggered by media reports or larger public debates about controllers.
Appeals
Appeals against decisions are possible in the German administrative jurisdiction. Court of first instance is the district administration court (Verwaltungsgericht) in Düsseldorf. Regularly an appeal against the courts decision is possible at the Superior Administrative Courts of North Rhine-Westphalia (Oberverwaltungsgericht NRW) in Münster.
